Ellen Noteware

Ellen Noteware is a nationally recognized trial lawyer and class action litigator who has recovered more than $4 billion for her consumers, investors, and other plaintiffs nationwide. Her practice focusses on consumer, antitrust, and ERISA litigation. Ms. Noteware has represented drug purchasers in several antitrust case where drug manufacturers suppressed generic competition, which resulted in hundreds of millions of dollars in settlements for her clients, often on the eve of trial, including, In re Namenda Direct Purchaser Antitrust Litig., (S.D.N.Y.) ($750 million settlement). Ms. Noteware also represented a class of elite mixed martial arts fighters against the UFC where she helped secure a $375 million settlement on the fighters' behalf. She also recently represented a class of students in Henry v. Brown University, (N.D. Ill.), a suit alleging that elite universities colluded to artificially depress financial aid awards which resulted in $319 million in settlement funds to date. Ms. Noteware has also litigated numerous breach of fiduciary duty ERISA cases, including In re Nortel Networks Corp. ERISA Litigation (M.D. Tenn.) ($21 million settlement). 

 

In addition to her settlements, Ms. Noteware has found success at trials and arbitration proceedings. She served on the trial team for Cook v. Rockwell Int'l Corp., (D. Colo.)  where the jury returned a $554 million verdict on behalf of thousands of property owners affected by contamination from the Ricky Flats nuclear weapons plant. At the time, it was the largest in Colorado history. She was awarded the Public Justice "Trial Lawyer of the Year" award for her efforts in that case. More recently, Ms. Noteware has also successfully represented consumers who purchased products at inflated prices due to corporate antitrust violations at confidential arbitration hearings.

 

Ms. Noteware graduated from Cornell University and the University of Wisconsin-Madison Law School where she won the Daniel H. Grady Prize for securing the highest grade in her class, served as Managing Editor of the Law Review, and earned Order of the Coif honors. Ms. Noteware clerked for the Honorable J. Calvitt Clarke, Jr. in the Eastern District of Virgina following law school.
