Levi & Korsinsky is investigating claims for false and misleading advertising by Post Foods, LLC. The investigation involves claims that Post Foods, LLC may have made unauthorized health claims on the labels of its Post Great Grains Digestive Blend cereals. Specifically, the product labels state, “By consuming at least 48 g of whole grains per day you can support healthy digestion and reduce the risk of several chronic diseases like heart disease and diabetes.” However, the Food and Drug Administration (“FDA”) has recently taken issue with this statement and concluded that the product is misbranded because the health claims made on the product packaging are not authorized by the FDA.
