In signing this letter the undersigned ("Client") hereby agrees to retain the law firm of Levi & Korsinsky, LLP (hereinafter, "Attorneys" or the "Firm") for the investigation of, and possibility of filing an individual and/or class action under the Worker Adjustment and Retraining Notification Act ("WARN Act") in connection with the termination of employees without proper notice by Murray Energy ("Murray Energy" or the "Company") and/or any related entity. In the event that Client and Attorneys agree to pursue litigation:

1. Attorneys agree to advance all expenses and disbursements in the litigation, and unless ordered by the Court otherwise, Client shall not in any event be liable to pay.
